Abstract. Nusyuz is an act carried out by his wife disobediently and obediently by fulfilling her interests to her husband without a clear and correct reason. That action is something that is not justified by the Shariah law '. The term nusyuz is often equated with unfair business which is done not only for wives but also husbands. A husband who does not agree to accept by providing for his wife and children who receive, even though he is able to. The purpose of this normative research is to learn about the epistemology of nusyuz from fiqh discussion. The method used using the normative method is also called the doctrinal method by using concepts and analytical methods. Primary data material in this agreement was published in fiqh books that have relevance to nushuz and secondary data materials used to support from books, journals, and opinions of experts in accordance with this paper. Processing and analysis is done by collecting primary and secondary source materials to answer problems that have been formulated by using induction and deduction penalties. The fuqaha agree that nusyuz is an act that is not justified in sharia ', considering that Islam provides knowledge about the essence of marriage in accordance with Islamic law. The husband has full responsibility for his wife and children. This responsibility provides for the family to meet all the needs of families and children at home. The husband is also required to give advice to the wife when the wife is doing wrong and protect her by giving good help without getting hurt. Likewise the wife, must agree to provide in a manner and commonly conveyed that has been written in the source of Islamic law.
